Social benefits aim to create equal opportunities and equal possibilities for social development. They particularly include the following services: 

Child Benefit (Kindergeld)

Child benefit (also known as family allowance), which is independent of parental income, is automatically granted after the birth of a child and is part of the family burden equalization system. Depending on the family's income situation, child benefit can be considered either a tax credit or a social welfare payment.

Parental Allowance (Elterngeld) (formerly Child-Rearing Allowance)

Parental Allowance (Elterngeld) is a family benefit funded by taxes and dependent on parental income, available to parents who are employed or not employed, and is granted until the child reaches the age of two at the latest. The state child-rearing allowance offices are responsible for processing applications for Parental Allowance. 

Housing Benefit (Wohngeld)

Housing Benefit (Wohngeld) is a social welfare payment in the Federal Republic of Germany for individuals with low incomes who receive a rent subsidy for housing or a subsidy for the ongoing costs of an owner-occupied property. 

Educational Support

Educational support is provided under the Federal Training Assistance Act (BAföG) as individual funding for pupils and students. While pupils receive the benefit as a grant, apprentices and students receive half of the benefit as a grant and half as a loan.

“BAföG for Apprentices” – BAB (Vocational Training Allowance)

Vocational Training Allowance (BAB) is state funding that apprentices and participants in a “vocational preparatory training measure” can apply for. The purpose of this funding is to provide an apprentice with a financial basis if their training location is too far from their parents' home, making it necessary to maintain their own household. Therefore, state support is not only granted to students – we are happy to provide information on this during a consultation and assist in cases of rejected applications.

Time Commitment and Duration of Proceedings

  • If necessary, an application for a preliminary injunction can be filed with the Social Court, with a decision typically rendered within a few days.
  • Otherwise, the duration of court proceedings before the Social Court is largely determined by the courts and often extends over several months.

Costs and Fees

  • An initial consultation for consumers is available for a maximum of Euro 190.00 plus statutory value-added tax.
  • Further, including written, consultation and representation depending on the scope, complexity, and significance for the client.
  • For court representation, billing is based on the Lawyers' Remuneration Act (RVG) or a flat fee agreement, with an early assessment of the anticipated cost risk.
  • Legal protection insurance policies typically cover the costs of court proceedings.
  • In cases of financial hardship, it is possible to apply for legal aid.
