Lawyers do not always have complete freedom in determining the fees for their services. Different regulations must be observed depending on the nature of the case.

Fees for Legal Advice and Out-of-Court Representation

Regarding the amount of legal fees in the business sector, billing based on time spent or flat-rate agreements are both viable options.

Initial Consultation Fees

Do you require an initial legal consultation to professionally assess the chances of success in a legal matter? Our lawyers focus on weighing effort against economic viability, providing commercially sound assessments. The fee for this is determined by the value of the subject matter, the time spent, and the complexity of the case. The fee for the initial consultation will, of course, be communicated to you in advance when scheduling an appointment. To the client's advantage, the fee for the initial consultation will be fully credited towards subsequent fees if further engagement is pursued.

Out-of-Court Costs

For out-of-court activities in civil law, the amount of legal fees, when billed according to the RVG (German Lawyers' Remuneration Act), is based on the amount in dispute. For example, in the case of a claim, it is based on the disputed payment claim. A business fee is charged for out-of-court representation, and a settlement fee is charged if an agreement is reached with the opposing party.

For other activities where a "disputed amount" is difficult to determine, such as individually tailored, legally sound contract drafting, legal support during agreement negotiations, or legal assistance in complex matters, a fee agreement, for example, on an hourly basis or a flat rate based on the respective activity, is advisable.

Representation in Court

Costs for Litigation

For court activities, fees are at least due according to the legal provisions of the RVG (German Lawyers' Remuneration Act). These will be generally explained below. Naturally, this overview cannot replace a detailed explanation and consultation in a personal discussion with a lawyer.

In civil proceedings before the court, a procedural fee is incurred for court representation and the submission of legal documents. A hearing fee is charged for the lawyer's attendance at court appointments. In the event of an agreement with the opposing party in court, a settlement fee may also be incurred.

For repeated representation, fee agreements are also advisable here to ensure greater cost transparency.
