The Applicable Right of Withdrawal

During sales events that occur as part of a package tour, legal regulations apply to the purchase of jewelry or carpets in Turkey, Northern Cyprus, Cyprus, Crete, Greece, Morocco, and Dubai. These regulations are comparable to German consumer protection laws regarding door-to-door sales or promotional trips.

Here's how you can proceed.

Can I withdraw from the purchase contract, return the goods, or get my money back?

A two-week withdrawal period is granted to the buyer. It is crucial that the buyer is informed about this option before making the purchase. However, in practice, this rarely happens. If this information was not provided, it is possible to withdraw from the purchase even at a later date.

German Law May Apply to Package Tours

Furthermore, under certain conditions as per Article 29 I No. 3 of the EGBGB (Introductory Act to the German Civil Code), German substantive law may still apply to contracts primarily concluded abroad. This is particularly the case if the seller co-organized or initiated the international trip during which the sales event took place. Consequently, the concluded purchase contract can be validly revoked in accordance with the German right of withdrawal for door-to-door sales (§ 312 para. 1 No. 2 BGB). However, proof of cooperation between the tour operator and the seller must be provided in such cases.
