Insult

Anyone who expresses their displeasure in a manner that harms another's honor and thereby causes harm to others will be punished.

One might get annoyed with another road user in traffic and express that anger with a clear hand gesture. The accusation of insult quickly arises. Whether through words or gestures – the offense of insult can take many forms. The Criminal Code distinguishes between insult, slander, and defamation.

Insult is punishable according to § 185 of the German Criminal Code (StGB). The provision states: Insult is punishable by imprisonment for up to one year or by a fine, and if the insult is committed by means of a physical assault, by imprisonment for up to two years or by a fine.

The criminalization of insult offenses primarily aims to protect the personal honor of the insulted party. Accordingly, an insult is only prosecuted if a criminal complaint is filed. As an affected person, you can file such a complaint with the police or public prosecutor's office.
