If a person in Germany is strongly suspected of a crime, the public prosecutor's office applies for an arrest warrant from the competent investigating judge. If there is a so-called reason for detention, such as a risk of flight or re-offending, suspects are placed in pre-trial detention.

This is not always justified, and there are legal avenues to challenge it. Strict formal requirements must also be observed.
